1. Acceptance of Terms

By downloading, installing, or using QwikKube ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the Software.

2. Description of Service

QwikKube is a free desktop application designed to help users manage Kubernetes clusters and resources. The Software provides:

• Real-time visualization and management of Kubernetes resources
• Multi-cluster management capabilities
• Resource editing tools and a built-in YAML editor
• Performance monitoring and metrics
• A local AI assistant for diagnostics, resource explanations, and YAML generation — powered entirely by on-device inference with no external API calls

3. Cost and License

QwikKube is provided free of charge for both personal and commercial use. There are no premium tiers, feature restrictions, or usage limits. We may accept voluntary sponsorships or donations, but these are entirely optional and do not affect your access to the Software.

Subject to these Terms, we grant you a worldwide, non-exclusive, royalty-free license to:

• Download, install, and use the Software on any number of devices you own or control
• Use the Software to manage your Kubernetes clusters for any lawful purpose
• Make backup copies for archival purposes
• Share direct links to our official download pages so others can obtain the Software

4. Trademarks and Brand Protection

The name "QwikKube," the QwikKube logo, and associated branding are trademarks of the QwikKube project. You may use our name and logo to refer to the official Software (for example, in blog posts, reviews, or recommendations). However, you may not:

• Use the QwikKube name, logo, or branding on any modified, repackaged, or derivative version of the Software in a way that suggests it is an official release
• Distribute altered binaries under the QwikKube name or any confusingly similar name
• Use the QwikKube name or branding to endorse or promote other products or services without our written consent

The official Software is distributed exclusively through our website (qwikkube.com) and our GitHub repository. If you obtained QwikKube from any other source, we cannot guarantee its integrity or safety.

5. Prohibited Conduct

You agree not to:

• Modify, tamper with, or reverse-engineer the Software for the purpose of injecting malicious code, malware, spyware, or any harmful components
• Redistribute modified or repackaged versions of the Software that contain malware, adware, bundled unwanted software, or any code not present in the official release
• Misrepresent any modified version of the Software as an official QwikKube release
• Use the Software to gain unauthorized access to Kubernetes clusters or any systems you do not have permission to manage
• Use the Software in any way that violates applicable laws or regulations

6. Privacy and Data

QwikKube is designed with privacy as a core principle:

• The Software does not store your Kubernetes credentials on our servers
• All Kubernetes connections use your existing kubeconfig files
• No cluster data is transmitted to our servers
• The Software does not collect any usage analytics or telemetry data
• The built-in AI assistant runs entirely on your device — no data is sent to any external AI service or API

7. User Responsibilities

You are responsible for:

• Ensuring you have proper authorization to access and manage your Kubernetes clusters
• Maintaining the security of your Kubernetes credentials and access keys
• Complying with your organization's policies regarding Kubernetes access
• Backing up important data before making changes to your clusters
• Downloading the Software only from official sources (qwikkube.com or our GitHub repository)

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE SOFTWARE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (WHICH IS ZERO).

10. Updates and Modifications

We may update the Software from time to time to add features, fix bugs, or improve performance. Updates may be installed automatically or require manual action. We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the modified Terms. We will make reasonable efforts to communicate significant changes through our website or GitHub repository.

11. Termination

You may stop using the Software at any time by simply uninstalling it. If you materially violate these Terms — in particular, the Prohibited Conduct or Trademarks and Brand Protection sections — we reserve the right to pursue any available legal remedies. Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, and Trademarks and Brand Protection) will continue to apply.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
